The team of Jim Griffin, Steve Torline and Lori Sellers recently obtained a dismissal of a complex lawsuit for the Salina Regional Health Center involving the Federal False Claims Act commonly known as a “qui tam" lawsuit. The dismissal culminated almost 10 years of legal proceedings involving SRHC's decision to terminate a physician's hospital privileges at SRHC.

After lengthy briefing by both parties, the district court dismissed the substantive qui tam claims finding that plaintiff failed to establish that Medicare conditioned payment to SRHC on the quality of care regulations. The district court also dismissed the retaliatory discharge claims because the plaintiff failed to file the discharge claims within the three-year statute of limitations. ...
