Cassels Brock Wins in the Supreme Court of Canada
Cassels Brock litigation lawyers Lorne Silver and Robert Cohen were successful in the Supreme Court of Canada decision of Madsen Estate v.
Saylor (2007 SCC 18). This was a controversial but important decision on the rights of joint account holders who receive funds by way of rights

The case is of significance because it upheld the trial decision of Van Melle, J. who found that an adult child who was a joint holder of a bank
account with her parent was presumed to hold the funds in that bank account on behalf of the estate of the deceased parent (the presumption of
resulting trust). This presumption had been rejected by the Ontario Court of Appeal, which held that there was a presumption of gift in favor
of the adult child in those circumstances (the presumption of advancement).
