This was a controversial but important decision on the rights of joint account holders who receive funds by way of rights of survivorship prescribed by common joint bank account agreements used by banking institutions throughout Canada.

The case is of significance because it upheld the trial decision of Van Melle, J. who found that an adult child who was a joint holder of a bank account with her parent was presumed to hold the funds in that bank account on behalf of the estate of the deceased parent (the presumption of resulting trust).
