Hanneke Farrand is a director in ENSafrica’s tax department and head of the private clients department. She specialises in local and international individual and employees’ tax matters, and provides trust and tax advice in respect of South African and offshore trusts. She has also advised companies on local employees’ tax matters, including various aspects of South African and offshore employee incentive schemes.

Hanneke further assists clients with the establishment and ongoing implementation of South African and offshore trusts in the appropriate jurisdictions for purposes of expanding their international business operations, growing personal wealth or planning for future generations. In this context, she advises on the impact of the Organisation for Economic Co-operation and Development’s Common Reporting Standard and disclosure requirements for settlors, funders and trust beneficiaries.

She has helped numerous clients to regularise their tax and exchange control affairs with the South African Revenue Service (“SARS”) and the South African Reserve Bank (“SARB”) through various voluntary disclosure programmes and negotiations with these authorities.

Hanneke also advises individuals who wish to relocate to, or emigrate from, South Africa, particularly on the related tax and exchange control implications. She further manages the process in obtaining the relevant tax clearance certificates and approvals from SARS and SARB, respectively, and the remittance of funds from South Africa.

Hanneke provides tax litigation support relating to her areas of expertise. She has acted for various South African and multinational clients on a number of tax issues, and has often assisted clients in negotiations with SARS. This includes responding to queries and assessments where necessary. She is also actively involved in the alternative dispute resolution processes. 

Hanneke has extensive expatriate tax experience, including applying double taxation agreement relief where individuals work in and outside of South Africa, as well as in respect of the corporate tax implications for foreign employer companies conducting business in South Africa.

In addition, she assists with the calculation of expatriates’ South African income tax liability (such as calculating expatriates’ monthly payroll and biannual reconciliation of payroll accounts) and ensuring compliance with local revenue practice (i.e. submission of income tax returns and provisional tax payments to SARS).
