Ulmer & Berne LLP Secures a $3.2 Million Jury Verdict

After a three-day trial in the United States District Court, Northern District of Ohio, Ulmer & Berne LLP partner Stephanie Dutchess Trudeau secured a major victory for Hitachi Medical Systems America, Inc. of Twinsburg, Ohio. The Firm’s client, which sells and services health care magnetic resonance imaging (MRI) systems, sued Horizon Medical Group, Inc. of Sarasota, Florida and 12 related limited liability companies located in Florida, Georgia and Texas. Horizon manages the LLCs and the LLCs operate various MRI centers. The case involved a business dispute between the Firm’s client and Horizon and its entities.

A seven-person jury returned a unanimous verdict for the full amount of the sums Hitachi claimed Horizon and its 12 related LLCs owed under theories of breach of contract and unjust enrichment. The jury also decided that Horizon must pay Hitachi’s attorney’s fees and costs. This amount will be an additional sum on top of the verdicts. The verdicts were $2,823,783.80 against Horizon and a combined total of $378,225.66 against the LLCs.
