Managing a workforce that is increasingly performing job functions from locations other than an employer's office requires the involvement of human resources personnel who are well-versed in the Americans with Disabilities Act's (ADA) Title I requirements related to a job's "essential functions." HR personnel must have an in-depth understanding of the reasonable accommodations that may be necessary and the analysis of a possible undue burden of accommodations on the business. Many businesses are unaware, however, of the ADA's Title III requirements, which have provided a basis for an explosion of litigation by advocacy groups against businesses claiming that their websites are not accessible to individuals with disabilities.
