Trade and business secrets law enacted

It is here. The German Trade and Business Secrets Law (Geschäftsgeheimnisgesetz; GeschGehG) came into effect on April 26, 2019. Companies wishing to ensure protection of their business and trade secrets (such as customer, supplier and staff lists) in the future are required to take and document appropriate non-disclosure measures. This is effective immediately. Federal Labor Court (Bundesarbeitsgericht; BAG) dated January 23, 2019 – 7 AZR 733/16 The unfounded limitation of the term of an employment contract, when an employee is employed again by the same employer, is only permissible when and if the application of the prohibition of unfounded fixed-term employment under Sec. 14(2) s. 2 Part-Time and Fixed-Term Employment Law (Teilzeit- und Befristungsgesetz; TzBfG) would be unreasonable for the parties. Heuking Advises Aquila Capital on Sale of Three DHL Freight Terminals to Savills IM

AGRAF German Real Estate Holding No. 1, a fund managed by Aquila Capital, has sold three freight terminals in Berlin, Leimen near Heidelberg, and St. Ingbert in Saarland to Savills Investment Management. A team led by Dr. Sönke Görgens and Dr. Michael Dröge, both Partners at Heuking Kühn Lüer Wojtek, advised Aquila Capital on the sale. Savills Investment Management acquired the three freight terminals on behalf of European Logistics Fund 2 for a purchase price of some EUR 48.7 million. The three properties constructed in 2014 each feature 5,000 square meters of rental space and are leased out to Deutsche Post Immobilien with an average remaining term of about ten years...
