Profile

Carmen Weite litigates a wide array of civil and commercial disputes — including business torts, breach of contract, insurance coverage, medical malpractice, noncompete agreements, product liability, and trade secret misappropriation — in state and federal courts throughout the Southeast.

Carmen helps clients navigate virtually all stages of litigation, from pre-suit through appeal. She has particular experience with written and document discovery, and taking depositions, as well as drafting and arguing motions. She has successfully briefed and argued dispositive motions at the trial court level and, when appropriate, obtained a favorable settlement or proceeded with an appeal. Carmen recently served as the lead attorney in opposing an appeal to the Alabama Supreme Court and obtained affirmance of the trial court’s summary judgment dismissal of all claims against her client. In addition to litigation, she advises clients on business issues such as contract drafting and negotiation, litigation risk management, and commercial transactions.

Before joining Bradley, Carmen worked at a Birmingham litigation boutique, where she gained experience that spans the litigation spectrum. She handled everything from high-stakes environmental litigation to cases involving profound personal injuries and tragic wrongful deaths. Carmen began her legal career — the day after she was sworn into the Alabama State Bar — by taking the deposition of a key witness in a heavily contested insurance coverage lawsuit. She experienced many early successes as a young lawyer, and her practice grew as clients and other lawyers began to call on her to handle more complex cases.

Carmen is licensed to practice law in all state and federal courts in Alabama, Florida, and South Carolina, as well as all state courts in Tennessee. She has also practiced before the American Arbitration Association and Equal Employment Opportunity Commission.

Even beyond the courtroom, Carmen remains dedicated to the law and community service. She holds leadership positions with the Birmingham Bar Association Young Lawyers Section (vice president of Public Service), Defense Research Institute (Young Lawyers Steering Committee), and James E. Horton Inn of Court (Membership Committee).

Carmen attended Cumberland School of Law at Samford University, where she graduated in the top 6% of her class. In her final year of law school, Carmen simultaneously served as chief judge of the Trial Advocacy Board, copy editor for the Cumberland Law Review, teaching assistant for the Basic Skills in Trial Advocacy class, a justice on the Honor Court, and an advocate on the National Trial Team.

As a two-year member of Cumberland’s National Trial Team, Carmen competed in six national trial advocacy competitions and won every round in which she advocated. In June 2017, Carmen won the Award for Best Use of Courtroom Technology at the Top Gun National Mock Trial Competition in Waco, Texas. In November 2017, Carmen was one of four team members to win first place at the Florida National Trial Advocacy Tournament in Gainesville, Florida, where she also earned individual recognition as the competition’s Best Advocate.
