Profile

Andreas Kistler is a partner in Carey Olsen's trusts and private wealth and litigation teams in Jersey. He specialises in the court-related aspects of the trusts and private wealth team's practice and has acted in numerous cases involving allegations of breach of trust, fraud and professional negligence, both for plaintiffs and defendants. He also has experience of mediation of such disputes.

He is also regularly involved in applications by trustees for administrative directions, applications by trustees and beneficiaries for relief on grounds of mistake, applications for orders approving compromises of disputes on behalf of minor, unborn and unascertained beneficiaries and applications for rectification of trust instruments. In addition, he practises all other aspects of Jersey commercial litigation, including disputes concerning investment funds and Jersey companies, contractual disputes and Jersey intellectual property rights.

His practice has seen him engaged in proceedings brought in the Jersey Courts by trustees, beneficiaries and non-beneficiary spouses in connection with matrimonial proceedings abroad. He acted in the landmark case of J v K [2016]JRC110 which concerned a disputed application to give effect to a letter of request to obtain information about a Jersey trust for the purpose of foreign matrimonial proceedings involving one of the beneficiaries. He also resisted the appeal in the Jersey proceedings concerning the Poon divorce [2015]JCA109, where the Trustee's decision to exclude the wife from further benefit under the Trust was upheld.

Andreas has been recognised in Legal Week's Private Client Global Elite listings in 2021 and is named in the Legal 500 and Chambers Guides in offshore dispute resolution and trusts categories in Jersey.

Professional Career

Significant Accomplishments

Andreas was admitted as a barrister and solicitor of the High Court of New Zealand in 2003. He joined Carey Olsen at the end of 2005 and became an Advocate of the Royal Court of Jersey and a partner in 2013.
