Profile

Andries Myburgh is an Executive at ENS in the Tax practice, and specialises in corporate and international corporate tax consulting, mergers and acquisitions advisory and tax dispute resolution assistance.

Andries’ experience includes advising companies (across various industries) on the tax implications applicable to a broad range of transactions, including corporate restructures, merger and acquisition transactions (tax due diligence investigations and tax-efficient transaction structuring advice), private equity transactions, and financing/funding arrangements. 

Andries has expertise in advising corporates and B-BBEE shareholders on the tax-efficient structuring,  re-structuring, financing and refinancing of broad-based black economic empowerment (B-BBEE) investment and ownership transactions, including loans, equity, preference share funding and notional vendor financing arrangements.

Andries also has expertise in advising on the South African tax aspects of local and international private equity fund transactions (advising on both the sell-side and the buy-side).

Andries also has extensive industry experience in the mining sector, where he consults regularly to mining companies on a various range of domestic and international corporate tax, mining tax and mineral royalty-related matters.

From a tax dispute resolution perspective, Andries assists companies in responding to SARS audits/investigations, preparing and lodging objections and appeals, alternative tax dispute resolution and tax court, High Court and Supreme Court of Appeal matters, including advising on alternative remedies to resolve tax court disputes.

Prior to joining ENS in 2013, Andries was a tax partner in the tax & legal practice of KPMG where he held the positions of the Head of Corporate Tax and the Head of Energy and Natural Resources Tax.

Andries regularly assists the Minerals Council and other clients with the preparation and submission of comments on tax legislation and related matters to the South African Revenue Service and National Treasury.

He also served as an ad hoc member of the sub-committee on mining of the Davis Tax Committee due to his mining tax and mineral royalty tax experience.

Andries has authored articles for and has been quoted by numerous tax-related issues in publications including Mining Weekly, Mining Review Africa, Financial Mail and Business Day.
