Profile
Mr. Pozhidayev focuses on litigation and arbitration, as well as regulatory, corporate and commercial law.
Representative experience:
- advised Coca-Cola Ukraine in numerous matters arising under Ukrainian law with respect to the company's activities in Ukraine, including litigation in Ukrainian courts in connection with defending the company's intellectual property rights, advertising, and consumer claims;
- represented L'Oreal Ukraine in various disputes, including dispute with State Inspection of Ukraine on Consumer Protection as regards compliance with the labeling requirements; dispute with former employee related to wrongful termination, etc.;
- successfully represented interests of Group DF in a series of corporate disputes against OJSC "Uralkalii" with regard to shares of PJSC "Azot" (Cherkassy);
- represented a shareholder in a corporate dispute with OJSC "Azot" (Cherkasy), one of the biggest manufacturers of mineral fertilizers and other chemicals in Ukraine;
- defended VR Capital (Manmade Enterprises Ltd) in a series of corporate disputes with Nadra Bank in Ukrainian administrative and commercial courts, i.e. challenging USD 443 million additional share issue of Nadra Bank;
- represented Credit Agricole before Ukrainian commercial courts in connection with collection of multimillion corporate debts and recovery against mortgaged property and is advising on the issues of execution and enforcement of the court rulings on the matter;
- acted for Swedbank in a series of disputes with its borrowers regarding collection of large outstanding debts totaling over USD 100 million, recovery against mortgaged property, as well as advised in respect of insolvency proceedings;
- advised Telenor, a major shareholder of a leading Ukrainian mobile operator Kyivstar G.S.M., in litigation and arbitration matters including representation in commercial courts of all levels in corporate disputes, representation in general courts in connection with various lawsuits and fact-finding proceedings and advice on various arbitration matters;
- represented Lyndhurst Development Trading S.A. (in receivership and liquidation) in various court proceedings relating to USD 45 million debt collection from PJSC "Univermag "Ukraina" (shopping mall) and validity of respective claim;
- represented Ukrainian subsidiary of Ghelamco Group in disputes with tax authorities regarding tax notices of appeal decisions on reducing the amount of budgetary compensation.
