Profile

Austin McMullen is a board-certified Creditors’ Rights Specialist. He also regularly represents businesses in the highly regulated food and beverage industry and in other government affairs  matters.

As a Creditors’ Rights Specialist, Austin is one of a small but select group of Tennessee attorneys who have completed a rigorous certification process established by the American Board of Certification. Austin zealously represents his clients in bankruptcy, commercial and real estate litigation, workout, judgment enforcement and execution matters. He also serves as the receiver of distressed businesses to successfully resolve and satisfy creditor claims.

Because of his specific experience in bankruptcy law and, in particularly, creditors’ rights, Austin possesses a detailed understanding of how the law works within the banking and financial services industry. He consistently delivers up-to-date legal advice, mitigates risks and tailors unique solutions to help his clients anticipate problems in advance. 

Not only does Austin regularly practice in all Tennessee bankruptcy courts, but he also handles cases in other state and federal courts. He has served on the board of the Tennessee Chapter of the Turnaround Management Association, the Board of Directors for the Mid-South Commercial Law Institute and as chair of the Bankruptcy Courts Committee of the Nashville Bar Association.  Austin has regularly contributed to the Norton Bankruptcy Law Adviser and was recognized by the Nashville Business Journal as one of the “Top 40 Under 40.”

Professional Career

Significant Accomplishments

Austin McMullen regularly represents a variety of secured creditors, debtors, and those involved in the receivership process. Austin assists clients with governmental administrative matters and election law issues, but also serves as a liaison when his clients need permits or have zoning disputes. He represents clients before the Tennessee General Assembly. Austin has represented healthcare providers seeking or challenging certificates of need. He has experience with commercial litigation, appellate law, insurance regulatory issues, and litigation involving nonconforming issues.
