Profile

Brian is a litigation partner in the firm’s Houston office.

He handles commercial disputes across a broad range of industries, including energy, healthcare and managed care, media and entertainment, and other commercially related areas. Brian is recognized as a Texas Super Lawyer in the area of business litigation with experience at all stages of litigation in state and federal court and in arbitration. He has represented both plaintiffs and defendants in matters involving claims of fraud, breach of contract, breach of fiduciary duty, tortious interference, copyright and trademark infringement, and violations of ERISA. In addition to his litigation practice, Brian advises clients on corporate compliance and due diligence for transactions implicating the Foreign Corrupt Practices Act.

During Brian’s practice at the firm, he worked as a volunteer prosecutor at the City of Houston Municipal Court where he tried numerous jury trials to verdict and handled all aspects of pretrial motions, voir dire, witness examination, and closing arguments.

Prior to joining the firm, Brian served for two years as a Judicial Law Clerk to U.S. District Judge David Hittner in the Southern District of Texas, where he was the lead briefing attorney on numerous cases covering a broad array of subject matters. Brian’s federal clerkship experience gives him a strong foundation for a diverse legal practice and a unique ability to provide clients with key insight into the judicial process.

Brian is a strong believer in equal access to justice and frequently handles pro bono matters from the Houston Volunteer Lawyers program. Most recently, Brian has helped mothers enforce their child custody rights by filing writs of habeas corpus for the return of children taken unlawfully by other family members.

Representative Experience

Energy Related Litigation

  • Represented a large midstream energy company in pursuit of damages after a natural gas producer breached a pipeline transportation agreement in Texas.
  • Represented an oil and gas operating company in defense of a multimillion-dollar surface lease dispute in Midland, Texas.
  • Represented several major oil and gas companies in defense of a multimillion-dollar international breach of contract dispute concerning construction of a semi-submersible processing facility in the Gulf of Mexico; case was tried to an international dispute resolution panel, which entered a favorable award of no liability.
  • Represented a major oil and gas company in defense of a multimillion-dollar international breach of contract dispute regarding the lease of an offshore drilling rig.

Health Care and Managed Care Litigation

  • Currently representing the Chapter 11 trustee of a bankrupt hospital in recovery of over $7 million in kickbacks paid to doctors in exchange for patient referrals.
  • Represented a managed care company in a fraud case against an out-of-network hospital and affiliated emergency clinics; obtained summary judgment award of $8.4 million based on the misrepresentations regarding the nature of the hospital-clinic affiliation and location of service.
  • Represented a managed care company in a fraud case against an out-of-network medical imaging company; obtained summary judgment award of $3.9 million based upon misrepresentations regarding the location of service.
  • Represented a managed care company in a two-week federal bench trial concerning a hospital’s ERISA claim for $50 million in alleged unpaid health benefits; trial court entered directed verdict of no liability against the managed care company.
  • Represented a managed care company in a two-week federal bench trial concerning competing ERISA claims with a hospital for alleged overpayments and underpayments; obtained reversal of trial court ruling that the managed care company had abused its discretion in paying health care claims to the hospital.
  • Represented a managed care company in a two-week federal jury trial in defense of a hospital’s breach of contract claim for millions in alleged unpaid medical benefits; jury returned a favorable verdict of no liability against the managed care company.
  • Represented several managed care companies in state and federal court to recover overpayments to out-of-network hospitals, ambulatory surgery centers, and other healthcare facilities based upon fraud, improper billing practices, and kickbacks to referring physicians.
  • Represented a managed care company in arbitration to recover overpayments made to a third-party medical billing company based upon misrepresentations concerning the billing company’s status as an out-of-network provider and the location of services.

Other Commercial Litigation

  • Represented an international apparel company in a copyright and trademark infringement dispute concerning the use of a design logo.
  • Represented a cable television network in a trademark infringement dispute over the design of its network advertising logo.
  • Represented a global credit management company in pursuit of damages from a transportation company and various officers based on alleged violations of the Securities and Exchange Act.

Corporate Compliance and Investigations

  • Represented various clients in anti-corruption matters, including FCPA due diligence in connection with mergers and acquisitions, joint ventures, and related transactions in the United Kingdom, Germany, China, India, Greece, Italy, and Argentina.
