Jack Selden, a partner in the Government Enforcement and Investigations, Litigation and Healthcare practice groups, has practiced law for 40 years. Previously he served both as the United States Attorney and as an Assistant U.S. Attorney for the Northern District of Alabama. Over the past 25 years, he has been extensively involved in defending clients in federal False Claims Act (FCA) investigations and litigation, as well as white-collar federal grand jury investigations and prosecutions.

Jack established the False Claims Act practice at Bradley more than 20 years ago, and the firm was recently determined in a study by Lex Machina to have represented the second largest number of defendants in public False Claims Act cases filed between 2016 and 2020. These cases have involved allegations of Medicare fraud, defense procurement fraud, financial fraud, other government contracting fraud, and securities fraud. One significant example is the FCA qui tam case against Aseracare Hospice prosecuted by the Department of Justice, in which Jack was the lead attorney defending Aseracare from the inception of the False Claims Act investigation through both the trial and the 11th Circuit appeal, resulting in a landmark court opinion in 2019 favoring healthcare providers on the issue of medical necessity.

For a period of 10 years beginning in 2009, Jack served as the chairman of the “DOJ Dialogue Group” Committee of the ABA’s Criminal Justice Section, which met regularly with the Attorney General of the United States and other leadership within the Department of Justice to discuss criminal justice issues, as well as parallel federal False Claims Act issues. He also previously served as a vice chair of the ABA Criminal Justice Section and is an active member of the National Association of Former United States Attorneys, where he served as president.

Jack represents hospitals, home health, hospice, therapy, skilled nursing facilities, and other healthcare providers, as well as defense contractors, banks, manufacturers, and a long list of corporations and individuals. From a parallel federal criminal investigation and civil action relating to allegations of a massive financial fraud to allegations of significant Medicare fraud, pharmaceutical and securities fraud, his clients rely on his experience, skillful guidance, and courtroom abilities to resolve challenging situations. His clients include or have included AseraCare Hospice, Community Health Systems, Encompass Health, SavaSeniorCare, Kindred at Home, Surgical Care Affiliates, HealthSouth Corporation, Golden Living, Carter Health Care, Raytheon Company, United States Football League (USFL), Chevron, Stifel Financial Corp., Sterne Agee Group, Inc., Caddell Construction Company, Tenet Healthcare, McWane, Inc., Centex Corporation, and Charter Communications.
