Profile

Javier is a partner in Garrigues’ Administrative and Zoning and Planning Law Department in Madrid.

Since joining the firm in 2000, he has provided advice to public authorities and other entities forming part of the public sector at state, autonomous community and local level, as well as to private clients (mainly companies) on a diverse range of matters, areas and sectors relating to administrative and planning activities.

He specializes in providing public procurement advice on incidents arising during the preparation, award, performance and termination of public sector contracts.

Particularly worthy of note is his involvement in the preparation and interpretation of numerous special administrative terms of tender (especially in relation to the construction, operation and financing of major infrastructure and public services); in the design of public-private partnership models for the execution of such infrastructure (especially using alternatives allowing for budget separation); and in providing advice to individuals on filing special procurement appeals before the courts handling contractual appeals.

Furthermore, Javier is an expert adviser in relation to all types of administrative procedures and appeals, above all in the field of the law on administrative penalties and the clawback of subsidies. He also has a rich wealth of experience in defending companies in all manner of judicial review appeals, including court claims for financial liability.

In the course of his professional career, Javier has also advised the public and private sectors on the applicable legislation and the interpretation of numerous legal rules across a range of industries, in particular in matters relating to energy, water, pharmaceuticals, health, banking, roads, transport, trade, property, planning, hotels, compulsory purchase, infrastructure and telecommunications, etc.

In addition, Javier has participated in due diligence reviews and in all kinds of administrative and regulatory matters in numerous M&A and restructuring transactions performed by Spanish companies in recent years, and has provided advice on several privatization processes involving public industries and companies.

He has assisted public authorities with the drafting of statues and regulations and has participated in the implementation of international technical assistance projects financed by multilateral bodies such as the World Bank, the Inter-American Development Bank and the European Commission. He is also experienced in the area of subsidies and public aid (in particular, those from European Union funds for the construction of major infrastructure).

Javier Manchado is a member of the Madrid Bar Association and the PPP Infrastructure Forum (an association that aims to promote partnerships between the public and private sectors throughout Spain for the development of public infrastructure projects using PPP methods).

Alongside his professional practice, Javier Manchado has been a lecturer on the Company Law Master’s course organized by Universidad Pontificia Comillas (ICADE) since 2006, and has also taught on the public procurement course offered by Escuela de Negocios CEU-Recoletos.

He is also a member of the teaching staff on the Advanced PPP Infrastructure Financing Program, organized by Instituto de Empresa Business School (I.E.) and has lectured on an array of administrative law-related subjects on the Executive Master’s Degree in Business Law, organized by Centro de Estudios Garrigues in conjunction with Harvard Law School.

Furthermore, he has spoken at IMAP (Madrid Institute of Public Administration) on several occasions and at numerous public law conferences organized by prestigious institutions and organizations such as Unidad Editorial, IFAES and IRR, etc.

Currently assigned different jobs of hiring and management of Human Resources for the Department in Madrid.
