Mark's practice focuses on health care liability, public liability, legal practitioners' liability, product liability and the insurance of those risks, vocational regulatory action taken against health practitioners, and clinical governance in hospitals and other health care facilities. He has over 23 years of insurance and health sector experience, with a strong local and international client base that includes insurers, reinsurers, captive insurers, corporate and institutional health care providers, medical defence organisations and multi-national and publicly listed resources and construction companies.

Mark advises our clients in relation to claims for damages for death and bodily injury, insurance policy coverage, professional conduct, clinical governance, risk management and relevant legislative compliance.

Mark's health care liability practice ranges from patient fatalities, serious brain injuries (including cerebral palsy caused by alleged obstetric negligence), "wrongful births", pharmacy errors, misinterpretation of diagnostic images, equipment failure, suboptimal ICU care and inappropriate accreditation of visiting medical officers.

Mark acts in multi-party disputes involving contractual indemnities, double insurance and breaches of contract for failures to effect insurance. He has wide-ranging experience with the complex insurance and indemnity arrangements prevalent in the resources, mining and construction industries. He also writes revisions to insurance policies and contracts in response to legal developments in those areas.

Mark acts for plaintiff personal injury law firms on instructions from their professional indemnity insurers. He also represents barristers in defence of professional negligence claims against them.

An experienced advocate, Mark appears as counsel in the District and Supreme Courts of Western Australia, the State Administrative Tribunal and in the appellate jurisdictions of the Court of Appeal and the High Court of Australia. He represents interested parties during coronial investigations and inquests. He also advises people in connection with parliamentary inquiries and appears before health performance and professional standards panels.
