Roshanak is an experienced litigator focused on assisting clients resolve issues in the most effective and efficient manner possible.

Roshanak defends financial institutions against claims involving the Fair Debt Collection Practices Act, state servicing or collection laws, Truth-in-Lending, Fair Credit Reporting Act, Gramm-Leach-Bliley, Telephone Consumer Protection Act, Real Estate Settlement Procedures Act and other applicable federal and state laws governing the servicing and collection of consumer debts. Roshanak also has 12 years of experience with Employee Retirement Income Security Act (ERISA) regulations in relation to life and disability insurance policies as well as plan administrator and employer’s fiduciary obligations, as well as complex commercial civil litigation involving products litigation, trade secret and non-compete agreements, breach of contract claims, fiduciary duty and civil conspiracy claims.

Relevant Experience

  • Second-chaired trial defending an insurance agency against claims of bad faith, negligent misrepresentation and violations of the Insurance Code and DTPA. Obtained summary judgment on behalf of insurance agent in multimillion-dollar suit in which plaintiff alleged Insurance Code violations, violations of the Texas Deceptive Trade Practices Act, violations of the Texas Securities Act, statutory fraud, common law fraud, negligent misrepresentation and negligence based on sale of annuities. Plaintiff sought economic, exemplary and mental anguish damages, as well as pre-and post-judgment interest, court costs and attorney’s fees. Obtained dismissal of grievance filed with the Texas State Bar regarding bankruptcy litigation.

Consumer Litigation

  • Represented banks, lenders, servicers and investors in a high-volume docket of complex business-related and financial services litigation in state and federal courts involving claims for wrongful foreclosure, breach of contract, constitutional violations, torts and violations of unfair and deceptive acts and practices statutes, assignment and securitization challenges, homeowner association foreclosures, national mortgage settlement and consent judgment violations, and alleged violations of the Telephone Consumer Protection Act, Fair Credit Reporting Act and Real Estate Settlement Procedures Act in Texas state and federal court.
  • Advised national mortgage servicer regarding compliance with Telephone Consumer Protection Act, Fair Debt Collection Practices Act, Real Estate Settlement Procedures Act and related policies and procedures.

ERISA/Insurance Litigation

  • Represented insurance companies involving ERISA-regulated accidental death & dismemberment policies, as well as life and critical illness policies.
  • Successfully resolved numerous interpleader actions on behalf of insurance companies and recovered attorney’s fees on behalf of insurance company clients.
