Scott counsels and defends employers facing a broad range of complex employment and labor-management issues.

Scott provides timely advice on avoiding and defending against employment matters including discrimination, harassment, and retaliation allegations, wrongful termination, theft of trade secrets, violations of restrictive covenants, and wage and hour issues. He also has experience drafting and implementing employer policies, employee handbooks, severance and release agreements, as well as managing the discipline and termination processes.

Scott’s traditional labor practice encompasses advice and representation for clients in response to charges before the National Labor Relations Board. In offering counsel, Scott prides himself on his attention to the client’s short- and long-term strategic business goals.

As an associate, Scott has aided clients in all stages of litigation in federal court, as well as administrative hearings related to the Fair Labor Standards Act, Title IX, the Occupational Health and Safety Act, Title VII, and others, and corresponding state law claims.

Prior to joining the firm, Scott worked at the US Department of Commerce, handling all aspects of the Agency’s nationwide employment and labor-management advice and litigation, including frequent litigation before administrative agencies such as the Equal Employment Opportunity Commission and the Merit Systems Protection Board, as well as interpretation of the Federal Labor Relations Act.

Relevant Experience

  •  Represented employers in lawsuits involving employment discrimination, harassment, retaliation, contract disputes, and allegations of violations of Title VII, OSHA, FMLA, and various state laws regarding discrimination.
  • Defended public client against Title IX and Section 1983 civil rights claims.
  • Defended large online retailer against unfair labor practice charges before National Labor Relations Board.
  • Defended national retailer franchisee against Fair Labor Standards Act lawsuit resulting in reduction of monetary liability by over 80%.
  • Advised national assisted living facility client on compliance with OSHA emergency preparedness regulations.
  • Worked with national grocery retailer to respond to notice of charges for alleged violations of OSHA regulations.
  • Assisted green energy provider in prosecuting allegations of violation of non-compete agreement and theft of trade secrets litigation.
  • Provided counsel to national energy company regarding compliance with national and state requirements regarding discrimination and harassment training.
  • Worked with national print and online media company to respond to allegations from the New York Department of Labor under that state’s Wage Theft Prevention Act.
  • Advised government contractor on compliance with federal prevailing wage laws.
  • Drafted national and multi-state employee handbooks, mandatory arbitration agreements, class action waivers, and severance and release agreements for national retailer, media, and energy companies.
  • Provided COVID-19 and vaccination compliance advice to multiple national clients.
  • Pro bono work includes offering free legal advice to small businesses through the DC Small Business Clinic, petitioning for protective orders under Virginia’s family abuse statutes, and representing clients through the District Court of the District of Columbia’s mediation program.
