Profile

Trevor Garmey is an associate in the firm’s white collar and internal investigations practice.

Prior to joining the firm, Mr. Garmey was a law clerk to the Honorable Irene C. Berger, US District Judge for the Southern District of West Virginia. During his clerkship, Mr. Garmey assisted Judge Berger in preparing opinions and evidentiary rulings for United States v. Blankenship, the nine-week criminal trial of the former chief executive officer of a coal company for compliance-related offenses and securities fraud.

Before his clerkship, Mr. Garmey served as an associate in the white collar and internal investigations practice at Cahill Gordon & Reindel LLP in New York City. Mr. Garmey has experience in a wide range of white-collar and civil litigation matters.

Relevant Experience

Independent Reviews, Monitorships, and Compliance Assessments:

  • Representation of the City of Charlottesville, Virginia in an independent review of the City’s response to various protest events during the summer of 2017. As part of this assignment, Mr. Garmey was embedded in Charlottesville for three months following the events.
  • Representation of David N. Kelley, the appointed Monitor in the Department of Justice’s criminal settlement with Toyota Motor Corporation. As part of this assignment, Mr. Garmey was embedded at Toyota’s North American headquarters for a total of five months in 2015.
  • Lead counsel in comprehensive compliance assessment for multinational corporation, following acquisition of domestic utility service provider.

Fraud, Anti-Corruption, and the Foreign Corrupt Practices Act:

  • Lead counsel in representation of German automotive executive in multi-jurisdictional investigation into accuracy of emissions disclosures, resulting in favorable resolution.
  • Representation of Fortune 200 apparel company in internal investigation into allegations of corruption in China.
  • Representation of former FIFA executive in concurrent investigations by the Department of Justice and the Cayman Islands regarding corruption in international soccer.
  • Representation of the Audit Committee of an international retailer in investigation by the Department of Justice and the Securities Exchange Commission into alleged violations of the Foreign Corrupt Practices Act.
  • Representation of a former executive of an investment bank in a Department of Justice investigation into alleged violations of the Foreign Corrupt Practices Act, stemming from hiring practices in China.
  • Representation of a private equity fund in an internal investigation into potential violations of the Foreign Corrupt Practices Act.

False Claims Act:

  • Representation of public agency in False Claims Act investigation into potential overpayments by Medicare and Medicaid.
  • Representation of third-party consulting company in documentary and testimonial subpoenas related to substantial false claims litigation in the Eastern District of Virginia.
  • Representation of educational enrichment provider in False Claims Act investigation into potential overpayments by the Department of Education.

SEC Enforcement and Counseling:

  • Representation of investment adviser in SEC investigation into alleged violations of the Investment Advisers Act, based on use of certain exchange-traded products in advisory accounts.
  • Representation of a senior executive of asset management division of an international bank in SEC investigation into potential violations of the Investment Advisors Act of 1940 and the Securities Exchange Act of 1934.
  • Representation of issuer in SEC investigation into accuracy of public statements issued in aftermath of adverse publicity regarding operations in Asia.
  • Representation of an investment bank in an SEC investigation into alleged manipulation of Foreign Exchange market.
  • Representation of prominent hedge fund manager in review of Section 13 disclosure procedures.

Export Controls, Sourcing, and Global Supply Chain Management:

  • Representation of exporter in joint investigation by Department of Homeland Security, Department of Commerce, and the Department of State into accuracy of commodity jurisdiction and commodity classification submissions.
  • Representation of retailer in investigation into sourcing practices in Bangladesh.
