Cambodia: Extended Deadline for Foreign Employee Work Permit Applications Approaching

On 28 March 2022, the Ministry of Labour and Vocational Training (“MLVT”) issued Notification 011/22 (“Notification”) to extend the deadline for foreign employee work permit applications from 31 March 2022 to 31 May 2022. The extension is aimed to help foreign employees who are not able to renew or apply for work permit on time in light of the COVID-19 outbreak.

We wish to highlight that the obligation to apply for foreign employee work permit applies to every employer in Cambodia employing foreign employees, including representative offices, branches, private or public limited companies, non-governmental organizations and associations. Failure to comply with the foreign employee work permit requirements could result in fines for each offense of up to USD 630 by the MLVT and/or up to USD 900 by a court. Furthermore, Chapters 5 and 6 of the Law on Immigration provide for a term of imprisonment of up to three months and deportation orders may also be issued to the foreign employees concerned.  

Unless you have done so already, we recommend that employers hiring foreign employees submit foreign employee work permit applications by the above extended deadline.
