Mexico: Extension of the Term of the Extraordinary Measures of the Health Emergency Declaration (COVID-19)

We have previously reported on the order that adopted the extraordinary measures under the COVID-19 health emergency declaration, published on March 31, 2020 (the “Order”), and the Technical Guidelines regarding certain essential activities described in Order, published on April 6, 2020. The Order mandated immediate suspension of all non-essential activities in the public, private, and social sectors until April 30, 2020, and described essential activities not subject to suspension. On April 21, 2020, the Secretary of Health published an order amending certain provisions of the Order (the “Amendment Order”). The Amendment Order provides the following:

  • The term of the suspension of all non-essential activities is extended until May 30, 2020.
  • Non-essential activities in municipalities with low or zero transmission of the virus will be resumed on May 18, 2020. The Secretary of Health is to issue criteria to define which municipalities fall under this category. However, and until further notice from the health authorities, persons considered to be vulnerable under the Order may not resume their activities and must remain at home even if they are in municipalities with low or zero transmission of the virus.
  • The Secretary of Health will issue guidelines to reduce mobility between municipalities with different transmission levels. The Federal Government and the state governments will work together to achieve this objective.
  • All the provisions of the Order and the Technical Guidelines will remain in force.
  • The Amendment Order became effective on April 21, 2020.
