PLMJ latest Victories on Competition

In the last years PLMJ has brought a significant number of claims opposing to the collection of Notarial and Registration charges from several companies. Such collection took place following the celebration of Public Deeds and Registration proceedings subsequent to “capital increase operations” and other statutory changes. Such charges’ collection is contrary to the provisions of the European Directive on raising of capital.

Just during the first semester of 2008, such claims brought by PLMJ have resulted in the recovery of approximately 300.000,00 Euros on the benefit of its Clients.

Besides these victories, PLMJ also succeeded in obtaining from the Competition Authority the decision to put an end to a three year legal action against Nestlé SA for the alleged practice of an Antitrust Offense.

In this case, the grounds for the proceedings regarded coffee delivery agreements containing exclusivity purchase clauses in the Horeca trade channel.

The decision ordering the closing of the procedure permitted Nestlé to avoid the application of a 1.000.000, 00 Euros fine.

These important successes confirm the superior quality of PLMJ’s performance and leadership in Portugal on the areas of EU Law and Competition.
