Autumn Highsmith has spent her career representing debtors, secured creditors, unsecured creditors, administrative agents, lessors, asset purchasers, and other parties in complex matters and advising corporate clients in their business dealings with financially distressed counterparties. Autumn is a trusted advisor to her clients and works diligently to understand their businesses and practical needs and to align her efforts on their behalf accordingly.

Autumn has handled many aviation restructuring matters and serves as trusted counsel for her aviation clients. Autumn served as special counsel to American Airlines and its affiliates in their Chapter 11 bankruptcies during which she assisted with the renegotiation of many of American Airlines’ purchasing, marketing, human resources and intellectual property agreements, and real estate leases.

Autumn has acted as debtor’s counsel in various Chapter 11 bankruptcy proceedings, including representing Guaranty Financial Group, Inc. and its affiliates in a case involving a $2 billion dispute with the Federal Deposit Insurance Corporation, representing Lothian Oil, Inc. and its affiliates in a case resulting in 100 percent payout to unsecured creditors, and representing SI Restructuring, Inc. (f/k/a Scholtzsky’s) and its affiliates in a case involving the successful sale of the debtors’ business as a going-concern. Among other things, Autumn’s clients regularly look to her to assist with defending against fraudulent transfer and preference actions, prosecuting objections to plans of reorganization and sales of assets, and enforcing various types of bankruptcy claims.

When not working on behalf of her clients, Autumn writes on various restructuring subjects and is involved in local and national bankruptcy organizations. Autumn is a member of the John C. Ford American Inn of Court and was recently elected to membership in the fellow of the Texas Bar Foundation. Autumn serves as a subcommittee head on Haynes and Boone’s Attorney Diversity and Inclusion Committee. Autumn was also the exclusive winner of the 2017 International Law Office and Lexology Client Choice Award for insolvency and restructuring lawyers in Texas.

Autumn has a passion for helping high school students develop an understanding of the legal process and serves as attorney coach of the mock trial team at Hampton Preparatory.

Significant Accomplishments

Representation of Erickson Incorporated and its affiliates in their Chapter 11 reorganization in the Northern District of Texas. Erickson confirmed a plan of reorganization less than five months after filing for bankruptcy; which reduced Erickson’s debt by over $400 million.

Representation of TransCoastal Corporation and CoreTerra Operating, LLC in their Chapter 11 bankruptcy cases, resulting in the confirmation of their prepackaged joint bankruptcy plan in 36 days.

Representation of the Unsecured Creditors Committee in the Chapter 11 bankruptcy case of Dallas businessman Sam Wyly.

Secondment as in-house counsel at major airline, involving negotiation of new agreements and restructuring of existing agreements.
