Cristen Rose, partner in the Litigation Practice Group in Haynes Boone’s Washington, D.C. office, focuses her practice on commercial and business litigation, insurance recovery, environmental litigation and regulatory compliance.

Cristen uses her knowledge and understanding of her clients’ businesses to develop strategies that maximize insurance coverage under their policies. Areas in which she advises clients regarding insurance include complex construction-related litigation, agricultural-related liability, climate change and coronavirus.

Cristen also has extensive experience representing companies that are subjects of investigations by the Environmental Protection Agency (EPA), the Consumer Products Safety Commission (CPSC), Food and Drug Administration (FDA), and Federal Trade Commission (FTC). She devotes a significant portion of her practice to the regulation of pesticides and other chemical products under the Federal Insecticide Fungicide and Rodenticide Act (FIFRA).

In addition to defending clients in governmental investigations and enforcement proceedings, Cristen counsels and defends clients on regulatory, contractual and licensing issues, and in federal arbitrations arising under FIFRA. She also has considerable experience with state and federal litigation involving product liability, false advertising and unfair trade practice claims. Her knowledge of both environmental law and commercial litigation has been manifested in articles published and seminars presented in both the United States and Asia.

Significant Accomplishments
Successfully tried three week arbitration securing coverage for securities-related claims.
Represented the manufacturer at the center of the largest recall of its kind in U.S. history in all aspects of federal multi-district products liability litigation involving over 100 class actions, opt out cases, potential cross-claims between the client and its co-defendant customers, and complex preservation issues.
Represented a Fortune 100 company in a putative class action alleging unfair and deceptive trade practices.
Represented a large pesticide company facing copyright infringement claims based on a federally-mandated product label.
Represented a Fortune 100 company in a federal investigation related to marketing and advertising statements.
Represented a manufacturer in a Congressional investigation arising out of a recall initiated by its customer.
Represented numerous pesticide suppliers and distributors in federally mandated, binding arbitrations involving complex economic and regulatory issues related to the amount of compensation owed to their competitors for reliance on certain scientific data supporting their product registrations.
Represented a manufacturer in putative class action alleging unfair and deceptive trade practices arising out of label statements.
Represented a real estate investment trust in federal litigation involving issues related to administrative review and environmental compliance.
