Profile
Jillian Gordon Foerster advises clients on both creating employee benefit plans and keeping those plans in compliance with frequently changing laws and regulations. She has extensive experience advising clients on the myriad requirements for their health and welfare plans under the Affordable Care Act, various compliance issues surrounding retirement plans, including 401(k) and 403(b) plans, and reviewing and amending employee benefit plan documents for various Internal Revenue Code, ERISA and other federal requirements, such as the new changes to DOMA law. In addition:
Affordable Care Act. Jillie works extensively assisting clients in keeping on top of all of the new requirements under the ACA. She is particularly knowledgeable regarding the Employer Shared Responsibility (or “Play or Pay”) provisions of the ACA and has worked with many client employers in determining their potential liability under these new rules and assisting them with the implementation of a compliance program.
HIPAA. Jillie counsels clients regarding privacy law and the complex requirements of HIPAA for group health plans, other covered entities, and their business associates.
IRS Voluntary Compliance Programs. Jillie advises clients on correcting retirement plan errors under the IRS’s voluntary compliance programs, and keeping such plans up to date by drafting amendments to plans for both changes in law and client-initiated changes.
Executive Compensation. Jillie reviews other nonqualified executive compensation arrangements and counsels clients in both interpreting and administering the plan as required by law as well as correcting errors and drafting amendments to such plans.
Tax-Exempt Organizations. Jillie assists nonprofit and tax-exempt clients in general governance issues, formation, and retirement plan compliance specific to tax-exempt and governmental entities, such as 403(b) and 457 plans.
