Kathrina (Kasia) Szymborski is an Associate in the Firm’s Litigation department. Her practice focuses on false advertising, trademark, antitrust, litigation involving FDA-regulated products, and complex commercial litigation. Ms. Szymborski maintains an active pro bono practice.

Prior to joining the Firm, Ms. Szymborski served as a law clerk to the Hon. Carl E. Stewart of the United States Court of Appeals for the Fifth Circuit and worked at an American international law firm.

Representative Matters

Secured a federal jury verdict for the world’s leading beverage company in a landmark Lanham Act advertising dispute. The U.S. Supreme Court had remanded the case for trial in 2014, holding that FDA regulations authorizing the company’s label did not bar the plaintiff’s suit. In 2016, a California federal jury returned a verdict in favor of our client after a six-day trial and less than a day of deliberation.

Obtained favorable summary judgment ruling for Fortune 500 company in false advertising class action.

Counseled civil rights organization in protection of its trademark against infringement.

Counseled collective licensing society on potential antitrust concerns arising out of licensing agreement with competitor.

Represented airfare distributor in federal antitrust litigation against major airline.

Pro Bono

Represented homeless youth in New York City in class action against the City for failure to provide shelter for any homeless youth in New York City who seeks it.

Represented interests of amici curiae in the U.S. Supreme Court case Evenwel v. Abbott, a case that considered the meaning of "one person, one vote."

Represented interests of amici curiae in the U.S. Supreme Court case Glossip v. Gross, challenging the constitutionality of Oklahoma's three-drug protocol for executions.

Represented interests of amici curiae in the U.S. Supreme Court case United States v. Welch, regarding retroactivity of the Court's previous invalidation of a clause of the Armed Career Criminal Act.
