Sarah Katherine Nichols represents financial institutions and mortgage servicers in a wide range of compliance, audit and litigation matters. She is a member of the Banking and Financial Services Practice Group and the Cybersecurity and Privacy team. Her practice has consisted of the regulatory compliance review of communications with customers and borrowers, including foreign language disclosures, security incident notices, demand and pre-foreclosure notices, annual notices, and responses to requests for information and notices of error. In addition to borrower communications, she has experience in the area of loss mitigation programs, including HAMP, as well as various loan and mortgage servicing fees, and property preservation and tenant issues. As part of her compliance review, she assists clients in historic compliance reviews through audits and internal investigations. Additionally, she has experience in identifying new and increased compliance demands on her clients and improving and updating a client’s internal policies and procedures in light of those demands. She works closely with business units to translate legal requirements into workable best practices. Sarah Katherine values a hand-in-hand working relationship with her clients, and offers clients efficient, thoughtful responses to business and regulatory issues that arise.

Her mortgage litigation experience includes mortgage-related fees and services, predatory lending, wrongful foreclosure, and statutory violations, such as violations of the Fair Credit Reporting Act, the Truth in Lending Act, and the Real Estate Settlement Procedures Act. She also has experience with consumer bankruptcy issues as they relate to residential mortgages.

In addition, Sarah Katherine has experience in other types of litigation matters, such as RICO lawsuits, white collar criminal matters, and insurance matters. She has extensive experience in all aspects of environmental law, including permitting, due diligence, regulatory matters, citizen suits, brownfield redevelopment, and managing and allocating environmental risks in corporate matters.
