Ms. Eaton's primary area of practice is litigation, with an emphasis on construction, product liability, industrial accident and toxic tort litigation. She is very experienced handling class actions, mass tort litigation, multi-district litigation and complex, document-intensive matters.

  • Construction Contract Review/Management and Dispute Resolution
  • Handles corporate litigation and contract disputes for NC/SC/GA-based general contractor 
  • Advises west coast-based lumber supplier on construction contracts, claims-handling, lien filings and litigation on the east coast
  • Advocates for New England-based construction company in contract and payment disputes in the Carolinas
  • Negotiates commercial construction contracts (AIA, ConsensusDocs, Government Contracts and Private Contracts)
  • Advises clients on commercial projects with construction management and best practices before, during and following construction, uses alternative dispute resolution to resolve disputes as early as practicable, files and/or defends lien claims as needed, and manages construction litigation to achieve optimal results for the client
     
  • Product Liability/Personal Injury Defense
  • Coordinates with industrial services client on industrial accident responses, investigation, and defense of claims and litigation
  • Achieved dismissal of wrongful death lawsuit against manufacturer of residential and commercial drainage and septic products
  • Coordinates strategic defense of Carolinas-based product supplier in New York asbestos litigation
  • Defended an international industrial chemical distributor in a bifurcated jury trial stemming from serious industrial accident involving hazardous chemicals
  • Provided trial support in jury trial in defense of a publicly traded company in litigation involving alleged pesticide damage to commercial crops
  • Represented multinational PPE manufacturer in a personal injury matter related to an industrial accident
     
  • Commercial Litigation
  • Defends a variety of product liability and commercial litigation matters for a Fortune 500 industrial services corporation to achieve results favorable to the client’s existing business needs and long-term goals
  • Directs corporate plaintiff litigation to recoup funds owed to business clients
  • Represents clients before state public service/utility commissions in energy/utility rate cases
  • Represents clients in administrative hearings involving employment-related issues, and defending employers in employment-related litigation, including discrimination, harassment and retaliation matters
  • Successfully resolved a series of lawsuits against a highway truck engine manufacturer related to alleged engine performance issues
  • Represented multinational insurance company in dispute over life insurance coverage on plaintiff’s claims of constructive fraud, unfair trade practices, breach of fiduciary duty
