<p>ALRUD Real Estate Practice experts Partner <a href="https://www.alrud.com/partner/AndreyZharskiy" title="Andrey Zharskiy">Andrey Zharskiy</a> and Associate <span data-color='#ff351b'>Alexey Kalinkin</span> prepared an article for <a href="https://aebrus.ru/en/aeb-publications/real_estate_monitor_4_2020/" title="AEB Real Estate Monitor">AEB Real Estate Monitor</a>.</p> <p>The article explains the resolution of the Constitutional Court of the Russian Federation No. 42-P dated October 16th 2020 regarding the unconstitutional character of section 1 of Article 8.8 of the Code of the Russian Federation on Administrative Offences (misuse of land plots).</p> <p>After the Resolution was adopted by the court, the issue of the liability of the right holder of the land plot, in case of failure to record the subsidiary type of permitted use, in the Unified State Register of Real Property, became clear.
