Buchalter Attorneys Successfully Obtained Important Ruling from the Ninth Circuit

Buchalter Lawyers Dylan W. Wiseman, Robert M. Dato, Brandon M. Carr and Tiffany Ng representing Ruifeng Biztech, Inc., obtained an important ruling from the Ninth Circuit.

On June 8, 2021, the Ninth Circuit denied petitioner’s writ in the matter of Quintara Biosciences, Inc. v. Ruifeng Biztech, Inc.  Quintara challenged an order striking and dismissing nine of its alleged DNA sequencing trade secrets.

The United States District Court, Northern District of California granted Ruifeng’s motion to strike or dismiss resulting from Quintara’s failure to comply with California  Code of Civil Procedure section 2019.210 and the court’s additional burden to set forth facts to supports its claim under the Defend Trade Secrets Act.

“The Ninth Circuit just sent a strong message to plaintiffs that the failure to identify trade secrets with sufficient particularity may result in the dismissal of their claims,” commented Dylan Wiseman.  “The ruling also blesses the federal court’s deploying California’s state court standard for describing trade secrets with reasonable particularity.  Credit to my team for their exceptional work.”
