November, 2012 - Lisbon, Portugal

PLMJ launches legal service to increase efficiency and reduce costs for companies involved in litigation and arbitration disputes. Efficient Litigation Risk Assessment – coordinated by José Miguel Júdice – has been created to help you plan decisions and anticipate risks in disputes to reduce costs and losses in times in times and efficiency. In constantly seeking effective and innovative solutions to your problems, PLMJ has now launched a new legal service to analyse risks and propose alternatives to using the courts. Through Efficient Litigation Risk Assessment, teams of PLMJ lawyers are available to analyse any case or dispute, to calculate the risks associated with the process and study alternatives to resolve it.
With more than 1.5 million cases pending before the courts, long delays in the trial phase and rising costs, going to court is often inefficient and increasingly expensive and unpredictable. This makes it especially important to consider whether there is any advantage in investing in legal proceedings that may be resolved too late because of the frailties of the company involved.

The Efficient Litigation Risk Assessment service is highly innovative and ground breaking in Portugal: it makes it possible to save both time and costs because it involves prior assessment of the potential risks of litigation. The service may also be useful in cases that are already before the courts but for which there are still out-of-court alternatives. This is because until March 2013 all legal proceedings that are settled out of court will be exempt from court fees, and this could mean a high value saving for both parties. The work is coordinated by PLMJ founding partner José Miguel Júdice. With over 35 years of experience and activity in the area of dispute resolution, José Miguel Júdice has put together a highly specialised team made up of lawyers with many years of experience in the various areas that are relevant to companies, including on an international level. At the request of companies and their lawyers José Miguel Júdice will form a dedicated team to analyse each case, calculate the risks and study the alternatives for its resolution. At the end of this process a report is presented to help companies to decide whether or not going to court is justified and, if the case is already in court, to help the parties and their lawyers to find common ground to end the conflict by agreement before the case comes to trial, or by using alternative means to the courts. PLMJ has more than 45 years of history and accumulated experience in dispute resolution in the commercial, civil, administrative, criminal, employment, tax, competition and intellectual property. This means the lawyers have all the know-how they need on the best practices to apply in each case as well as fast response capacity. PLMJ’s profile is increasingly that of a multiservice firm capable of offering a full service, which is fully integrated and specialised.
