The Government of India has recently issued several clarifications under both Customs as well as Goods and Services Tax (GST) Laws. These clarifications would certainly help to settle the dust on some critical issues listed below:

 

  • Monetary limit for initiating prosecution and arrests of importers and exporters enhanced
  • Facility of manufacture in Warehouse for Solar Power Generating Units withdrawn
  • Customs officials directed to give Free Trade Agreements precedence over CAROTAR in case of inconsistency
  • Routine summons to Managing Director, CEO, CFOs of companies to be avoided by GST officials
  • Departmental position regarding taxability of liquidated damages, compensation or penalty etc. clarified 
  • Clarity on applicable GST rates for certain services such as sale of land after development, hiring of vehicles for transport of employees etc.
  • Option to avail Transitional Credits extended to all taxpayers by Apex Court 
  • Guidance issued to GST officials on principles and procedures applicable in case of Arrest and Prosecution under GST
